Would he still be a hero if Terry were a person wrongly sentenced to death -- only there was no legal issue to overturn the decision?

Two comments:
Your acknowledgement of Judge Whitmore's heroism is well placed. With the increasingly extreme political landscape, it is the duty of the judiciary to uphold the law which protects us all. As controversial as it is, the members of the judiciary are as heroic as any soldier. They must make quick decisions in the face of life and death, and, as we have seen in recent weeks, their lives and the lives of their families are threatened. I salute them.

As to the "wrongly sentenced to death" comment, it is almost laughable. By definition if the person was WRONGLY convicted there would be a legal basis for overturning the decision.
